Terms of Service

wuoth is a marketplace and payment facilitator, not the operator of the hotels, tours, transfers or vehicles listed on it. Each listing is offered by an independent third-party vendor (a hotel, tour operator, car-hire company, or similar business) who is solely responsible for the accuracy of their listing, the quality and safety of the service delivered, and compliance with any licences the service requires.

Where wuoth quotes or books flights, this happens through a third-party flight-search and booking partner; the airline is the party actually providing carriage and is bound by its own conditions of carriage, which apply in addition to these Terms.

You must provide accurate information when creating a customer or vendor account and keep your login credentials confidential. You are responsible for all activity under your account. Guest checkout is available for customers who prefer not to create an account; a vendor account is required to list services for sale.

We may suspend or terminate an account that provides false information, is used fraudulently, or breaches these Terms.

A booking is a contract between you and the vendor (or airline) providing the service; wuoth facilitates the transaction and collects payment on the vendor’s behalf. A booking is confirmed only once payment has been successfully processed — a draft or pending booking created during checkout does not guarantee availability or price.

The trip cart lets you combine items from multiple vendors into a single payment. Combining items does not merge them into one contract with one vendor — each item remains a separate booking with its own vendor, cancellation terms, and confirmation, even though you pay for them together.

Prices, availability and vendor commission rates can change at any time before a booking is confirmed. The price you pay is the price shown and confirmed at the moment of successful payment.

We accept M-Pesa (via Safaricom’s Daraja API) and card payments (via Stripe). Card details are entered and processed directly by Stripe on its own secure, hosted payment page — wuoth never receives or stores your full card number. M-Pesa payments are authorised by you entering your M-Pesa PIN on your own phone in response to a prompt we send; wuoth never asks for or has access to your PIN.

All prices are shown in Kenyan Shillings (KES) by default; other displayed currencies are indicative conversions and the amount actually charged is the KES amount shown at checkout, unless your card issuer converts it at their own rate.

Cancellation terms (including any free-cancellation window) are set by the individual vendor and shown on the listing before you book. Where a booking qualifies, you can request cancellation from “My Trips” in your account.

Approved refunds are returned to your original payment method. Refunds are processed manually by our team once a cancellation is approved and are not instant — please allow a reasonable processing window, and expect M-Pesa refunds to typically arrive faster than card refunds. wuoth is not responsible for delays caused by your bank, mobile money provider, or card network.

Flights, and any listing explicitly marked non-refundable, cannot be cancelled for a refund through the platform; contact the airline or vendor directly regarding their own policies.

By listing a service on wuoth you confirm you have the legal right to offer it, that your listing is accurate, and that you will honour bookings made through the platform on the terms shown at the time of booking.

Commission. wuoth deducts a commission on each booking, at the rate shown in your vendor dashboard, before crediting the remainder to your wallet. Commission rates may differ by listing category and can be changed by wuoth with notice through the vendor portal.

Wallet & payouts. Your share of a booking is credited to your in-platform wallet once the customer’s payment is confirmed. You may request a withdrawal of your available wallet balance at any time; withdrawals are reviewed and paid out by our team and are not instant. wuoth may withhold a payout that is reasonably suspected to relate to a fraudulent, disputed, or refunded booking.

wuoth Pro. Vendors may optionally subscribe to wuoth Pro for a monthly fee, shown in the vendor portal, which is charged automatically from your wallet balance on each renewal date. If your wallet balance is insufficient at renewal, we allow a short grace period before automatically moving your account back to the free plan; this does not affect your listings, bookings, or wallet balance.

You agree not to: submit false information or fraudulent payments; attempt to circumvent wuoth’s payment system to book or pay outside the platform; scrape, reverse-engineer, or interfere with the platform’s normal operation; or use the platform for any unlawful purpose.

To the fullest extent permitted by Kenyan law, wuoth’s liability arising from your use of the platform is limited to the amount you paid for the specific booking giving rise to the claim. wuoth is not liable for the acts or omissions of vendors, airlines, or other third parties, nor for indirect or consequential loss (such as missed connections or lost enjoyment) arising from a vendor’s failure to deliver a service as described.

We may update these Terms from time to time. Material changes will be highlighted on this page; continued use of the platform after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or your use of the platform is subject to the exclusive jurisdiction of the courts of Kenya.
